Terms and Conditions - Circle by Tikamoon

1. Terms and Conditions

These Terms and Conditions govern the « Circle by Tikamoon » buy-back scheme (the “Scheme”) operated by TICKET FOR THE MOON, a simplified joint-stock company incorporated under French law, with share capital of €31,600, registered office at 4 Allée du Progrès, 59320 Englos, France, registered with the Lille Métropole Trade and Companies Register under number 492 684 279 (hereafter “Tikamoon”). The Scheme allows customers based in the United Kingdom to arrange for a TIKAMOON-branded piece of furniture to be collected and shipped to Tikamoon’s circular store in France, in exchange for a Gift Voucher redeemable exclusively on the Tikamoon UK website (https://tikamoon.co.uk), subject to eligibility as set out below. By participating in this Scheme, the customer sells their furniture to Tikamoon. Title in the furniture transfers to Tikamoon upon collection by the carrier.

2. Furniture Eligibility

All TIKAMOON furniture purchased on https://tikamoon.co.uk is eligible for the Scheme. With the following exceptions: Decorative items (including mirrors), Stand-alone basins (vasques), Upholstered seating containing foam

There is no minimum ownership period. To be eligible, furniture must be:

  • Complete — no missing parts or components
  • Functional — mechanically usable, even if showing signs of wear
  • Unmodified — if any aesthetic or functional modification has been made to the original model, the request will be assessed on a case-by-case basis and Tikamoon will communicate its decision following evaluation

  • 3. Preliminary Assessment

To submit a furniture buy-back request, the customer must complete the online form at https://tikamoon.co.uk. Following submission, the customer will be asked to provide:

Tikamoon will determine eligibility and assign a condition category (Very Good Condition, Good Condition, or Fair Condition) solely on the basis of the information and documents submitted. The Tikamoon customer service team is available throughout the process to assist.

Tikamoon reserves the right to decline a buy-back request if the furniture does not meet the criteria in Article 2. This decision is final and not subject to appeal or compensation.

Tikamoon accepts no liability for any disagreement regarding the condition category assigned.

    4. Shipping the Furniture

The Scheme is available by shipment only. All costs associated with shipping the furniture from the customer’s address in the United Kingdom to Tikamoon’s circular store in France are borne entirely by the customer.

    Weigh (kg) Price incl. VAT
    0-30 [TEXTE_TAB1_PRIX1]
    31-59 [TEXTE_TAB1_PRIX2]
    60-89 [TEXTE_TAB1_PRIX3]
    90 + [TEXTE_TAB1_PRIX4]

    This includes, without limitation:

  • Collection and delivery charges by Tikamoon’s partner carrier
  • All UK export formalities and associated costs. The customer acts as the declared exporter of the furniture from the United Kingdom and is responsible for complying with all applicable UK export regulations
  • All French import duties, customs clearance fees, and VAT applicable upon entry into France. As importer of record in France, Tikamoon (or its appointed freight forwarder) will handle French import formalities; however, the cost of all such duties and fees will be deducted from the Gift Voucher amount
  • Any other charges arising from the cross-border shipment, including surcharges for remote locations

  • These costs will be deducted from the Gift Voucher amount before it is issued, as detailed in Article 5. Tikamoon accepts no liability for delays, losses, or damage occurring during transit, or for any refusal of importation by customs authorities. In the event of a customs refusal or seizure, no Gift Voucher will be issued and Tikamoon will not be liable for any resulting loss.

Before collection, the customer must ensure the furniture is ready for transport: it must not be fixed to any wall or structure, must be unobstructed, and where applicable, components that were originally delivered dismantled (e.g. legs, fixings) must be dismantled and their fixings returned to the designated fittings.

By confirming the collection, the customer acknowledges and accepts all of the above conditions, including acting as declared UK exporter.

    5. Buy-Back Offer

Once Tikamoon has confirmed eligibility, it will send the customer a buy-back offer in the form of a Gift Voucher proposal. This offer will remain open for fifteen (15) days from the date of issue.

The Gift Voucher value is calculated as a percentage of the price originally paid by the customer on tikamoon.co.uk (in GBP, inclusive of VAT, net of any discounts, promotional codes, or delivery charges paid at the time of purchase), according to the condition of the furniture:

Condition Gift Voucher value (before cost deductions)
Very Good Condition 60% of original purchase price (inc. VAT, in £)
Good Condition 50% of original purchase price (inc. VAT, in £)
Fair Condition 30% of original purchase price (inc. VAT, in £)

From this amount, all shipping, customs, import duties, and VAT costs as described in Article 4 will be deducted to arrive at the final Gift Voucher value communicated to the customer.

If the total deductions exceed the calculated Gift Voucher value, no Gift Voucher will be issued. Tikamoon will inform the customer before any collection is arranged, so that the customer may decide whether to proceed at their own cost or withdraw from the Scheme.

    6. Gift Voucher Issuance

Once the customer has accepted the offer and the carrier has collected the furniture, Tikamoon will issue the Gift Voucher upon receipt of the furniture at its circular store in France and verification that it matches the description provided. If, upon receipt, the furniture’s condition differs materially from the description and photographs submitted, Tikamoon reserves the right to revise the Gift Voucher value downward or, in cases of significant discrepancy, to decline to issue a Gift Voucher. The customer will be notified and, in that event, may arrange collection of the furniture at their own expense within 30 days, failing which Tikamoon may dispose of it.

The Gift Voucher will be valid for one (1) year from the date of issue, for use exclusively on TIKAMOON products on the UK website (https://tikamoon.co.uk). It cannot be used on any other Tikamoon website and excludes gift cards.

The Gift Voucher is a personal, non-transferable code and cannot be combined with other promotional codes on tikamoon.co.uk. It has no cash value and cannot be refunded or exchanged for cash.

    7. Consumer Rights

The Scheme is a voluntary commercial arrangement by which the customer sells furniture to Tikamoon in exchange for a Gift Voucher. It does not constitute a consumer purchase, and the statutory 14-day right of withdrawal under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to the customer’s decision to hand over their furniture.

Any purchase subsequently made using a Gift Voucher on tikamoon.co.uk is subject to the Tikamoon UK Terms and Conditions of Sale in force at the time of purchase, and all applicable UK consumer rights including the Consumer Rights Act 2015.

    8. Regulatory Compliance

8.1 Register of Second-Hand Goods Dealers (France)

In accordance with Articles 321-7, 321-8 and R.321-1 to R.321-12 of the French Penal Code, Tikamoon is registered as a professional buyer of second-hand movable goods. In this capacity, Tikamoon is required to record each transaction and verify the identity of the seller.

The customer therefore agrees to provide, upon request and prior to any collection being arranged:

  • A valid government-issued identity document (passport or national identity card)
  • Proof of address dated within the last three months
  • The original purchase invoice for the furniture issued by tikamoon.co.uk
  • Tikamoon reserves the right to suspend or cancel a buy-back request if the customer fails to provide the required documents. By participating in the Scheme, the customer confirms that they are the lawful owner of the furniture and that it is free from any charge, lien, or third-party claim.

    8.2 Cross-Border Shipment — Post-Brexit Customs

Since 1 January 2021, the United Kingdom is treated as a third country for the purposes of EU customs and VAT rules. Each furniture shipment from the UK to France is therefore subject to UK export and French import formalities, including the issuance of a customs export declaration (SAD) by the customer as UK exporter, and an import declaration by Tikamoon (or its appointed freight forwarder) as importer of record in France.

The customer acknowledges that French import VAT and any applicable customs duties will be applied to the declared value of the furniture upon entry into France, and that these costs will be deducted from the Gift Voucher amount as set out in Article 5. Tikamoon will provide the customer with an estimate of these costs at the time of the buy-back offer.

Tikamoon shall not be liable for any delays, costs, or losses arising from customs inspections, duty reassessments, or any refusal of entry by French or UK customs authorities.

    9. Termination of the Scheme

Tikamoon reserves the right to suspend or terminate the Scheme at any time, at its sole discretion and without prior notice, without this giving rise to any right to compensation.

Where a buy-back offer has already been accepted by a customer and confirmed in writing by Tikamoon prior to any termination, Tikamoon will honour that offer.

    10. Acceptance of Terms

In operating the Scheme, Tikamoon collects and processes personal data (including name, contact details, proof of identity, and proof of purchase) for the purposes of delivering the service and complying with its legal obligations as a registered second-hand goods dealer under French law.

This data is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. It is not shared with third parties for commercial purposes. Identity documents provided for compliance purposes are retained only for the period required by law and then securely deleted.

Customers have the right to access, rectify, object to, erase, and port their personal data by contacting: donnees-personnelles@tikamoon.com.

Customers also have the right to lodge a complaint with the Information Commissioner’s Office (ICO): https://ico.org.uk.

    12. Governing Law and Disputes

These Terms and Conditions are governed by English law. Customers in Scotland or Northern Ireland retain the benefit of any mandatory consumer protection provisions applicable in their jurisdiction.

In the event of a dispute, the parties will first seek an amicable resolution by contacting Tikamoon customer services.

If no resolution is reached, customers may refer their complaint to an Alternative Dispute Resolution (ADR) provider approved by the Chartered Trading Standards Institute (CTSI). Details of the applicable ADR scheme will be provided upon request.

As a last resort, disputes may be referred to the courts of England and Wales, without prejudice to any mandatory rights of customers in Scotland or Northern Ireland.
